Terms & Conditions of Sale

These terms and conditions define the respective obligations of the Club PRO at the Festival Mondial du Cirque de Demain and of the customer in regards to the remote purchase of the Member PRO Ivory Card with subscription to the Club PRO.

ARTICLE 1 – PRICE AND NUMBER OF CARDS
1.1 The price of the PRO Card is forty euros all taxes included.

1.2 All orders whatever their origin are payable in euros.

1.3 The Club PRO reserves the right to change prices at any time. However, PRO Cards will be charged on the basis of the rates in effect at the time of receipt of the order.

1.4 Each PRO Card is individual and personalised.

ARTICLE 2 – PAYMENT

2.1 Payment of the PRO Card by the customer on the Club PRO website is exclusively by debit or credit card CARTE BLEUE / VISA and EUROCARD / MASTERCARD

2.2 The total sum of the order will be debited from the customer’s bank account at the moment of the final validation of the transaction.

2.3 A receipt of payment will be automatically be available to consult by the customer after the transaction in the customer’s newly created account which will be accessible via a login with password, details which will have been allocated at the time of purchase.

2.4 IMPORTANT: each bank transaction results in the creation of a single and unique card.

ARTICLE 3 – PAYMENT SECURITY AND PRIVACY
3.1 SECURING PAYMENTS
Electronic payments made in connection with transactions on the Club PRO website are secured by the SSL(Secure Sockets Layer) encryption procedure.
3.2 PERSONAL DATA
During the execution of an order, the Club PRO will be obliged to collect some personal data from the customer, for the management of said order: (the name and surname of the customer, their e-mail etc.)
These data will be used in the treatment and monitoring of the customer’s order.

ARTICLE 4 – ACCEPTANCE OF TERMS AND CONDITIONS
4.1 The Customer declares that they have read and accepted the Terms and Conditions before paying for their order.

4.2 Data recorded by the Club PRO will count as proof of the transaction completed on its website by the customer.

ARTICLE 5 – DELIVERY OF THE PRO CARD
5.1 The customer can collect their PRO Card upon their arrival at the Festival Mondial du Cirque de Demain, at the Club PRO Stand, by presenting their confirmation email or proof of identity.
5.2 By accepting these Terms and Conditions of sale, the client also accepts the conditions of use of the PRO Card.

ARTICLE 6 – USE OF THE CLUB PRO MEMBER CARD
6.1 The Club PRO team as well as the Cirque Phénix ticket inspectors reserve the right to carry out an identity check on the client upon arrival to the venue where the event will take place. The client must therefore be in possession of a valid proof of identity with a photo: identity card, passport, driver’s licence or residence permit.
6.2 Each PRO Card is named and personal and cannot be sold or given away, even for free.
6.3 It is strictly forbidden to reproduce, duplicate or counterfeit a Club PRO Card in any way.
6.4 The Club PRO team, as well as the Cirque Phénix ticket inspectors can refuse access to the venue where the event will take place if they realise that several copies or reproductions of a card are in circulation and that access has already been granted to a person possessing a copy or reproduction. The Club PRO as well as the Cirque Phénix ticket inspectors is not obliged to check the identity of the person in possession of the card
6.5 Each holder of a PRO Card automatically agrees to receive the Club PRO Newsletter at the email indicated during his or her registration. It is possible for the customer to unsubscribe from the mailing list at any point.

ARTICLE 7 – CANCELLATION, REFUND AND TRANSFER
7.1 From the date of purchase by the customer, PRO Cards cannot be exchanged or re-sold, or part-exchanged, except in the latter case, in the event of the cancellation of the Festival and the decision by the organiser to refund the Cards.

7.2 Customers are reminded that the proceedings of the Festival are subject only to conditions set by the organisers of said event, which are subject to their sole and exclusive responsibility. Consequently, any decision of cancellation, postponement or modification to the Festival program, will observe the conditions of these organizers, and is outwith the responsibility the Club PRO
7.3 In any event, all purchased Cards will not be reimbursed, even in the event of the client not using the Card.

ARTICLE 10 – APPLICABLE LAW / DISPUTES
10.1 All sales of the PRO Card on the Club PRO website of the Festival Mondial du Cirque de Demain is subject to French law.

10.2 In case of dispute, French courts have exclusive jurisdiction.

TERMS OF USE OF THE CARD
The PRO Card is subject to the terms and conditions of sale of the Club PRO as well as the following special conditions, which you accepted before the purchasing the PRO Card:

The PRO Card is personal and non-transferable. During ticket controls, you are required to be in possession of a valid proof of identity with a photo: identity card, passport, driving license or residence permit.
The PRO Card is only valid for the event, the date and conditions displayed on it and it must be kept until the end of the event.

During the event, customers agree to abide by the rules of conduct set by the organizer.
Moreover, the acquisition of this ticket implies acceptance of the rules of the venue of the event.
The Club PRO is not responsible for any anomalies that may occur during the ordering process or in the processing of the PRO Card that they have not intentionally caused or for negligence resulting in the loss, theft or misuse of the Card.
It is strictly forbidden to reproduce, duplicate or forge a PRO Card in any way whatsoever. Reproduction of the Card and use the copy of this Card are liable to criminal prosecution.
In case of non-compliance with all rules specified above, the PRO Card will be considered invalid.
